2. Eligibility

You must be at least 13 years of age to use GameShare™. If you are under 18, you represent that you have your parent's or legal guardian's permission to use the Platform. By using GameShare™, you represent and warrant that you meet these eligibility requirements.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration. You must notify us immediately of any unauthorized use of your account. GameShare™ reserves the right to suspend or terminate accounts that violate these terms.

4. User Content

You retain ownership of content you upload to GameShare™. By uploading content, you grant GameShare™ a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content on the Platform. You are solely responsible for the content you upload and must ensure it does not violate any third-party rights, laws, or our Community Guidelines.

5. Prohibited Conduct

You agree not to: upload illegal, harmful, or offensive content; harass, bully, or threaten other users; impersonate any person or entity; use the Platform for spam or unauthorized commercial purposes; attempt to gain unauthorized access to other accounts or Platform systems; use bots, scrapers, or automated tools without permission; circumvent any security or access controls.

6. Moderation & Enforcement

GameShare™ reserves the right to remove any content and suspend or terminate any account at our sole discretion, with or without notice, for any reason including violation of these Terms. Users who are muted or restricted may have their ability to post, comment, like, and interact with the Platform limited. Decisions regarding moderation are final.

7. Intellectual Property

The GameShare™ name, logo, design, and all associated trademarks are the property of GameShare™. All Platform software, features, and functionality are owned by GameShare™ and are protected by copyright and other intellectual property laws. Game screenshots and clips are the intellectual property of their respective game publishers and are shared under fair use for community discussion purposes.

8. Disclaimers

GameShare™ is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Platform will be uninterrupted, secure, or error-free. We are not responsible for any user-generated content or the actions of other users. Use the Platform at your own risk.

9. Limitation of Liability

To the fullest extent permitted by law, GameShare™ and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Platform. Our total liability shall not exceed the amount you have paid to GameShare™ in the twelve months preceding the claim, or £100, whichever is less.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of the United Kingdom.

We do not sell your personal information. Your public profile information (username, display name, avatar, bio) is visible to other users. Content you upload is visible according to Platform settings. We may share information with law enforcement if required by law or to protect the safety of our users.

We implement appropriate technical and organizational measures to protect your personal information, including: secure password hashing, token-based authentication with expiration, prepared SQL statements to prevent injection attacks, and HTTPS encryption for data in transit. However, no method of electronic storage is 100% secure, and we cannot guarantee absolute security.

6. Data Retention

We retain your account data for as long as your account is active. If you delete your account, we will remove your personal data within 30 days, except where we are required to retain it for legal purposes. Uploaded content may persist in backups for a limited period. Session tokens expire after 30 days of inactivity.

DMCA & Copyright Policy

1. Overview

GameShare™ respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) and applicable UK copyright law, we will respond to valid notices of alleged copyright infringement.

2. Gaming Content & Fair Use

GameShare™ is a platform for sharing gaming screenshots, video clips, and discussions. Game screenshots and short gameplay clips are generally shared under fair use / fair dealing principles for purposes of commentary, criticism, and community discussion. However, game publishers retain copyright over their game assets. If you are a rights holder and believe content infringes your copyright, please follow the process below.

3. Filing a DMCA Notice

If you believe that content on GameShare™ infringes your copyright, please submit a DMCA takedown notice through our Support Tickets system with the subject "DMCA Takedown Request" and include the following:

1. Identification of the copyrighted work you claim has been infringed.
2. Identification of the material that is claimed to be infringing, with enough detail to locate it on the Platform (e.g., URL or screenshot).
3. Your contact information (name, email address, physical address).
4. A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
5. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.
6. Your physical or electronic signature.

4. Counter-Notice

If you believe your content was removed in error or that you have authorization to use the material, you may file a counter-notice through our Support Tickets system with the subject "DMCA Counter-Notice" including:

1. Identification of the material that was removed and the location where it appeared before removal.
2. A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification.
3. Your name, address, and telephone number, and a statement consenting to jurisdiction.
4. Your physical or electronic signature.

5. Repeat Infringers

GameShare™ will terminate the accounts of users who are determined to be repeat infringers. We track DMCA notices associated with each user account and may issue warnings before termination at our discretion.
